The report focuses on the attitude of European countries with regard to lesbian, gay, bisexual and transgender people (LGBT) who apply for the status of refugee because they suffer persecution in their country of origin. It shows notable differences in how European countries deal with the issue, while Europe was to create a Common Asylum System. The report analyses the main legal issues in relation to LGBT asylum seekers, such as the underestimation of the criminalization of sexual orientation and homophobia in the countries of origin by some European states. It approaches both the European legislation on the subject as well as the practice of Member States.
